About This Website#

Operated by Stacy Garcia, MA, LPC

References to “we,” “us,” and “our” mean Creative Resilience Curiosity Lab. References to “you” and “your” mean the person accessing or using the website.

Educational and Informational Purpose#

The content, resources, products, apps, AI tools, courses, blog posts, and other materials available through this website are provided for educational and informational purposes.

They are not intended to replace professional mental health treatment, medical care, diagnosis, crisis intervention, legal advice, or other individualized professional services.

Using this website or purchasing a resource does not create a therapist-client, counselor-client, supervisor-supervisee, physician-patient, attorney-client, or other professional relationship.

Counseling, Coaching, and Consultation Services#

Counseling services, coaching services, consultation services, professional supervision, educational services, and digital product services are separate offerings.

Coaching and consultation are not counseling or psychotherapy. Participation in coaching, consultation, courses, or educational programs does not establish a therapist-client relationship.

A therapist-client relationship is formed only through a separate informed-consent process and a formal agreement for counseling services.

Website contact forms, newsletter forms, social media messages, and ordinary email should not be used for emergencies, urgent mental health concerns, or confidential clinical information.

If you or another person may be in immediate danger, contact local emergency services or an appropriate crisis resource in your location.

No Professional or Clinical Advice#

Information presented on this website is general in nature. Strategies and resources may not be appropriate for every individual, family, classroom, organization, or clinical situation.

You are responsible for determining whether a resource is appropriate for your circumstances, role, setting, population, and professional scope of practice.

Licensed professionals, educators, and other users remain responsible for exercising their own professional judgment and complying with applicable ethical rules, workplace requirements, school policies, laws, and licensing standards.

Children and Minors#

Some resources available through this website are designed for use by children or teenagers with the involvement of a parent, guardian, educator, counselor, or other responsible adult.

Unless a specific service expressly states otherwise, children under 13 may not independently create accounts, make purchases, subscribe to email communications, or submit personal information through this website.

Adults supervising minors are responsible for reviewing resources and determining whether they are developmentally and contextually appropriate.

Websites or online services directed to children under 13 may be subject to COPPA requirements, including parental notice and verifiable parental consent when personal information is collected.

AI-Assisted Tools and Content#

Some services or resources may use artificial intelligence to generate suggestions, prompts, summaries, activities, educational content, or organizational support.

AI-generated output may be incomplete, inaccurate, outdated, inappropriate for a particular user, or affected by the information entered into the tool. Users should independently review AI-generated material before relying on or sharing it.

Do not enter confidential clinical information, protected health information, identifying student information, passwords, financial information, or other sensitive personal data into an AI tool unless the tool expressly states that it is authorized and appropriately configured to receive that information.

AI tools offered through this website are not therapists, doctors, crisis responders, legal advisers, or substitutes for qualified human judgment.

Accounts and Account Security#

Certain areas of the website may require an account.

You agree to:

  • provide accurate and current information;
  • protect your username, password, and access credentials;
  • avoid sharing your account unless the applicable license allows it;
  • promptly notify us of suspected unauthorized use; and
  • accept responsibility for activity conducted through your account.

We may suspend or terminate accounts that violate these Terms, misuse resources, threaten website security, or interfere with other users.

Purchases and Payment#

Prices, product descriptions, included materials, access periods, and purchasing terms will be displayed before checkout.

Payments may be processed through third-party payment platforms identified at checkout. We do not control all features, interruptions, security practices, or policies of those third-party platforms.

You agree to provide accurate billing information and authorize the applicable charges presented at checkout.

Applicable taxes may be added when required.

Digital Products and License#

Unless a product listing expressly states otherwise, the purchase of a digital product gives the purchaser a limited, non-exclusive, non-transferable, revocable license to use the product for the permitted purpose described in its listing or accompanying license.

A purchase does not transfer copyright or ownership.

You may not:

  • resell, redistribute, sublicense, or publicly post a product;
  • share downloadable files outside the permitted license;
  • upload products to shared drives, websites, databases, AI training collections, or file-sharing platforms for access by unauthorized users;
  • remove copyright, branding, attribution, or ownership notices;
  • claim the material as your own;
  • use the content to create a substantially similar competing product for sale; or
  • use the product in unlawful, harmful, deceptive, or exploitative ways.

Separate classroom, school, practice, organization, team, or commercial licenses may be required when stated in the product description.

Refunds and Cancellations#

Refund eligibility is governed by our Refund and Cancellation Policy, which is incorporated into these Terms by reference.

Because digital products may be delivered or made accessible immediately, certain digital purchases may be non-refundable after download, access, or delivery, except where required by law or where our posted policy provides otherwise.

Any subscription, membership, or automatically renewing service must clearly disclose its billing terms and cancellation process before purchase. Subscription practices and material terms should be presented clearly rather than hidden inside general terms.

Courses, Workshops, and Training#

Course and workshop descriptions will identify the intended audience, format, included materials, and any applicable access period.

Completion of a course does not automatically confer professional licensure, certification, continuing-education credit, competency, or authorization to practice unless the offering expressly states otherwise.

Participants are responsible for verifying whether a course satisfies requirements imposed by their licensing board, employer, school, professional organization, or jurisdiction.

Intellectual Property#

The website and its original content, including text, graphics, illustrations, mascots, branding, downloadable files, product designs, games, activities, course materials, prompts, software interfaces, and other creative elements, are owned by or licensed to Creative Resilience Curiosity Lab.

They are protected by applicable copyright, trademark, and other intellectual-property laws.

No content may be copied, reproduced, republished, sold, modified, distributed, or commercially exploited except as expressly permitted in writing or under the license accompanying a purchased product.

User Submissions#

If you submit reviews, comments, questions, suggestions, feedback, testimonials, files, or other content, you confirm that:

  • you have the right to submit it;
  • it does not violate another person’s rights;
  • it does not contain unlawful or malicious material;
  • it does not disclose confidential information without authorization; and
  • it is truthful and not misleading.

You retain ownership of your original submission. However, when you voluntarily provide public-facing feedback or content, you grant us permission to display and use it for the purpose for which it was submitted, subject to applicable privacy and testimonial permissions.

We will not knowingly publish personally identifiable clinical information as a testimonial.

Acceptable Use#

You may not use the website or its services to:

  • violate a law or another person’s rights;
  • harass, exploit, threaten, or harm another person;
  • collect information about minors without proper authorization;
  • upload malware or interfere with website security;
  • attempt unauthorized access to accounts, systems, or data;
  • scrape or harvest content in violation of these Terms;
  • impersonate another person or misrepresent an affiliation;
  • generate or distribute harmful, discriminatory, fraudulent, or illegal material;
  • bypass payment, licensing, access, or usage restrictions; or
  • use resources in a manner that creates unreasonable risk for another person.

Third-Party Websites and Services#

The website may link to or integrate with third-party platforms, stores, applications, embedded media, payment processors, email providers, AI services, or social-media platforms.

Links and integrations are provided for convenience. We do not control and are not responsible for the availability, content, privacy practices, security, pricing, or policies of third-party services.

Your use of a third-party service is governed by that provider’s own terms and policies.

Privacy and Cookies#

Our collection and use of personal information are described in our Privacy Policy.

Our use of cookies and similar technologies is described in our Cookie Policy and cookie-preference controls.

Where required or offered, users may accept, decline, or customize non-essential cookies through the available cookie-preference controls.

Email Communications#

When you subscribe to the newsletter or expressly request communications, you authorize us to send the requested emails.

You may unsubscribe from marketing emails using the unsubscribe link included in the message.

Transactional messages related to purchases, accounts, access, or customer service may still be sent when necessary.

Commercial email is subject to requirements including accurate sender information, non-deceptive subject lines, a valid postal address, and a working opt-out method.

Availability and Changes#

We may update, modify, suspend, replace, or discontinue website features, resources, products, or services.

We do not promise that every feature or resource will remain available indefinitely or that the website will operate without interruption or error.

When practical, material changes affecting paid access will be communicated through the website, account, or email address associated with the purchase.

Disclaimer of Warranties#

To the fullest extent permitted by law, the website, content, products, and services are provided on an “as is” and “as available” basis.

We disclaim warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent those disclaimers are legally permitted.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

Limitation of Liability#

To the fullest extent permitted by law, Creative Resilience Curiosity Lab and its owner, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the website, resources, products, or third-party services.

Where liability cannot legally be excluded, liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, intentional misconduct, or other non-waivable legal obligations.

Indemnification#

To the extent permitted by law, you agree to indemnify and hold harmless Creative Resilience Curiosity Lab and its owner from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse of licensed materials.

Suspension and Termination#

We may restrict, suspend, or terminate access when a user materially violates these Terms, misuses resources, fails to pay required charges, threatens security, or engages in unlawful conduct.

Sections concerning intellectual property, licensing, disclaimers, liability, and dispute resolution will continue to apply after termination where appropriate.

Governing Law#

These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Changes to These Terms#

We may revise these Terms periodically.

The updated version will be posted on this page with a revised “Last updated” date. Material changes will not be applied retroactively in a manner that is unfair or deceptive.

Severability#

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent legally permitted.

Entire Agreement#

These Terms, together with the Privacy Policy, Cookie Policy, Refund and Cancellation Policy, applicable product licenses, and any service-specific agreement, constitute the agreement governing use of this website and its general offerings.

Separate signed agreements for counseling, supervision, coaching, consultation, custom development, or other professional services will control if they conflict with these general website Terms.
